BINI’s lawyer says vlogger’s post caused “emotional and mental distress.”

May kinalaman ito sa 25-minute vlog ng BINI na sila ay kumain at nag-rate ng iba-ibang Filipino delicacies and desserts.
Ang video na iyon ay mapapanood sa isang U.S.-based YouTube Channel, na umani ng iba-ibang reaksiyon mula sa netizens.
Inireklamo ng BINI ang spliced video na in-upload ng isang vlogger patungkol sa BINI.
Ayon sa legal counsel ng BINI na si Atty. Josabeth Alonso ng Alonso and Associates Law Firm, pinutakti ng matinding batikos ang BINI dahil sa malisyosong pag-splice ng video na iyon.
“The uploaded spliced version was cut to 2-minutes and only showed only their negative reactions, completely changing the show’s narrative.

“This fueled online hate and bashing against BINI. This even escalated to personal attacks, name-calling, and grave insults.
“The malicious splicing of the video unjustly threw them in a bad light, causing irreparable emotional and mental distress,” paliwanag ng abogada.
Ang BINI ay binubuo nina Gwen, Colet, Maloi, Stacey, Aiah, Jhoanna, Sheena, at Mikha.
Nasa pangangalaga sila ng Star Magic, ang talent management arm ng ABS-CBN.
THE LAWSUIT
Ang isinampang reklamo ng BINI laban sa di tinukoy na vlogger ay paglabag sa Sections 4B and 6 of Republic Act 10175 sa ilalim ng Cybercrime Prevention Act of 2012.
Sa ilalim ng Section 4B, ayon sa pagsasaliksik ng PEP.ph (Philippine Entertainment Portal), nakapaloob ang iba’t ibang uri ng computer-related offenses tulad ng computer-related forgery, computer-related fraud, at computer-related identity theft.
Nakasaad sa probisyon ng batas na ang computer-related forgery ay may kinalaman sa “input, alteration, or deletion” ng computer data na nagreresulta sa “inauthentic data.”

Ang isa pang reklamo ng BINI laban sa vlogger ay ang unjust vexation o paglabag sa Article 287 ng Revised Penal Code.
Ito ay anumang uri ng “act o omission” na naglalayong mang-inis, mang-irita, makagulo, at makapagdulot ng pagdurusa sa isang tao nang walang “lawful or justifiable cause.”
STAND AGAINST DIGITAL ABUSE
Wala man lang daw konteksto ang video.
Ipinaalala ni Atty. Alonso na ang paglalahad ng impormasyon online ay may kaakibat na responsibilidad.
Saad niya: “It must be remembered that freedom to post online is not an absolute right, and must be accompanied by truth, accountability, and responsibility.
“Right to free speech ends when it starts to malign reputations or cause harm and damage upon others.
“BINI is taking a strong stance against this digital form of abuse which is prevalent. Literally anyone may fall victim.”
